19.01.06NEWS ABOUT OGI-SARIN.

As Sarin Technologies Ltd. disseminated recently amongst members of the diamond guild and customers, Sarin has initiated proceedings in Belgium against OGI Systems Ltd., based on the alleged infringement by OGI of Sarin’s registered patent.

As opposed to the impression desired by Sarin - as if Sarin has been granted an operative remedy against OGI - reality is fundamentally different.

Not only is the litigation between OGI and Sarin at its very beginning - the parties are not supposed to render their evidence before the year 2007 - but also OGI applied to the Court in Antwerp in a motion to abolish the registration of said patent.

It is worth emphasizing that - unlike the legal situation in Israel and in the US - in Belgium a patent is registered without being pre-examined, with the effect that its validity is only questioned and examined by the court where some third party has so applied; Therefore, Sarin's said patent is - indeed - registered, but not necessarily valid!

In the course of the proceedings in Belgium, which - as mentioned above - are at their first stages, and which are to be heard by a special tribunal of 3 judges, the parties will introduce their respective systems; OGI - intending to introduce, amongst other things, its automatic computerized marking technology, developed back in 1999 - is confident that, at the end of the day, the court will hold that not only has OGI not infringed any legal or proprietary right of Sarin, but that Sarin is the one who has unlawfully exploited the rights of others.

Let it be clear that - as opposed to any slander aimed at OGI - OGI is unreservedly entitled to sell all its systems and products worldwide.
